From September 1, the \u2018supervision exception\u2019 that applied to adults who regularly teach or care for children has disappeared in England, Wales, and Northern Ireland. Even if a teacher or person in charge is present, if the activity meets the frequency and time requirements, it is classified as a regulated activity with children, and the agency can review enhanced background checks and Children’s Barred List checks.<\/p>\n

This does not mean that a new DBS test will automatically be required for every volunteer who comes into contact with a child even once. Organizations must consider the content and frequency of activities and whether they occur at night, and the law amendment itself does not order blanket inspections for all organizations.<\/p>\n

Previously, some volunteers, who were fully supervised by schools, sports clubs and youth groups, were outside the scope of children’s regulated activities. How often should I do this?<\/h2>\n

Government guidance explains that the frequency requirement is met if the relevant activity occurs on more than three days in a 30-day period, or includes the opportunity for face-to-face contact at least once between 2am and 6am. Representative examples include a parent who helps with weekly reading or an assistant coach who takes charge of activities four days a week. Roles that do not meet these criteria, such as one-off event assistance, are not automatically included.<\/p>\n

What does a DBS check show?<\/h2>\n

If the role is a regulated activity, the organization will be entitled to an enhanced DBS check containing general criminal history information, as well as information from the Child Employment Prohibition List. A banned person cannot engage in the activity and the institution must not allow it. Even if you have an existing certificate, you must separately check whether it includes prohibited list information and whether you are subscribed to the update service.<\/p>\n

What are organizations and volunteers doing now?<\/h2>\n

Agencies should list the currently supervised assistant roles and determine what, how often, and if they are performed at night. If you qualify for a new classification, we will follow your sector guidance to determine if an appropriate inquiry is required. It is safer for volunteers to check the role classification and application path with the placement agency rather than applying for a paid inquiry first on their own.<\/p>\n

What is the scope that is still confusing?<\/h2>\n

This change does not change the definition of regulated activities for adults and does not group all participants in educational and cultural events in the same way. There are also differences in the legal basis and application procedures in England, Wales and Northern Ireland.
